वैश्यावृति के नाम पर महिलायों का शोषण क्यों?

       कहते हैं देश दुनिया में महिलाओं की स्थिति लगातार मजबूत हो रही है| वे आर्थिक स्वतंत्रता हासिल कर रहीं हैं| अनेक महिलायें नौकरी और कारोबार के क्षेत्र में शिखर पर हैं, व्यावसायिक सफलता उनके कदम चूमती है| इसके बाबजूद दुनिया का महिलायों से संबंधित सबसे प्राचीन व्यवसाय यानि वैश्यावृति के नाम पर महिलायों का शोषण किया जाता है| इस शोषण के लिए जिम्मेदार वही महिलायें हैं जो कभी महिला सशक्तिकरण तो कभी नैतिकता के नाम पर वैश्यावृति को गैर-कानूनी बनाने को सही ठहरातीं हैं| वैश्यावृति का विरोध का ढोंग करके समाज में सस्ती लोकप्रियता आसानी से प्राप्त की जा सकती है| लेकिन विचार करने की आवश्यकता है कि क्या वैश्यावृति को प्रतिबंधित कर देने से महिलाओं का शोषण रुक जायेगा या इसमें और वृद्धि होगी| एक आंकड़े के अनुसार, भारत में वैश्यावृति लगभग पूर्णतः प्रतिबंधित होने के बाबजूद कुल डेढ़ करोड़ वेश्याएँ हैं, जो दुनिया के कई देशों की जनसँख्या से भी अधिक है| महिलाएं वैश्यावृति में कैसे आती हैं| ये सही है कई बार गरीबी के कारण पिता अपनी बेटी को बेच देते हैं तो कई बार धोखेबाज़ प्रेमी अपनी प्रेमिकाओं को बेच देते हैं| कई बार पति भी अपनी पत्नी को जबरदस्ती शरीर बेचने भेजता है ताकि उसके पैसे से गृहस्थी के साथ उसकी शराब का खर्च निकले| तो कुछ स्त्रियाँ पैसे की तंगी के चलते खुद इस व्यवसाय को चुन लेती हैं| लेकिन प्रश्न यह है कि क्या वैश्यावृति को प्रतिबंधित कर देने से महिलाओं पिता, पति या प्रेमी के द्वारा उसका शोषण रुक जायेगा| इसका उत्तर है नहीं| वैश्यावृति का मूल है पुरुष की शारीरिक यौन आवश्यकता तथा उसकी पूर्ति का मूल्य उसके द्वारा शारीरिक सेवा देने वाली वैश्या को चुकाया जाना| समाज का दायित्व इतना भर है कि जो स्त्री किसी पुरुष की यौन आवश्यकता की पूर्ति कर रही है उसे इस कार्य का उस पुरुष से उचित पारश्रमिक मिले|

       वैश्यावृति को प्रतिबंधित करने से कुछ पैसे कमाने के लिये सड़कों पर भटकती गरीब लड़कियाँ पुलिस –प्रशासन के निशाने पर आ जातीं हैं तथा इन कानून के रखवालों को उसको अपने पारिश्रमिक का एक हिस्सा देना पड़ता है| अपितु कभी-कभी इन कानून के रखवालों की अथवा इनके ऊपर अधिकारी एवं नेता गण की यौन आवश्यकता की पूर्ति भी निशुल्क करनी पड़ती है, जो निश्चित रूप से शोषण है| एक उदाहरण वैश्यावृति से अलग एक बारबालाओं के पेशे से मिल जाता है| महाराष्ट्र सरकार द्वारा 2005 में मुंबई में बारबालाओं को प्रतिबंधित कर दिया, जिसका परिणाम बारबालाओं की दुर्गति के अतिरिक्त और कुछ नहीं हुआ| लगभग 75000 बारबालाओं को या तो घरों में काम करना पड़ा (जहाँ इनका शोषण नहीं हुआ, इसका कोई प्रमाण नहीं है) या इन्हें अरब तथा दक्षिण-पूर्व एशियाई देशों में निर्यात कर दिया गया या फिर ये स्वयं कॉलगर्ल बन कर रह गयीं| पुनः स्त्री वैश्यावृति को प्रतिबंधित करने से समाज में छिपकर एक अपमानित जीवन जीने के लिए विवश हो जाती है| उसकी संतानों को स्कूल में प्रवेश नहीं मिलता है जिससे वे बच्चे-बच्चियां पुनः इस पेशे में आने के लिये मजबूर कर दिए जाते हैं|   

                पुरातन भारत में वैश्याओं को नगरवधू के रूप में जाना जाता था| जैसा की नगरवधू शब्द से ही प्रतीत होता है, इस व्यवसाय में कार्यरत महिलाओं को आजकल की तरह अपमानित एवं शोषित नहीं होना पड़ता था| भारत में इस्लाम के आगमन के बाद से युद्ध में जीती हुई काफ़िर महिलाओं की मंडियां लगायी जाती थीं, जिसमें जानवरों की तरह उन्हें ख़रीदा तथा बेचा जाता था| आज भी इस्लामिक स्टेट के आतंकवादी यजीदी महिलाओं की इसी प्रकार मंडियां लगाते हैं| कुछ सभ्य कहलानेवाले स्वीडन जैसे देशों ने इस कारोबार पर अंकुश लगाने की दिशा में कदम उठाते हुए वहाँ वेश्यावृत्ति पर प्रतिबंद्ध न लगा शरीर खरीदने को प्रतिबंधित किया है| इसलिए वहाँ कुछ पैसे कमाने के लिये सड़कों पर भटकती गरीब लड़कियाँ पुलिस –प्रशासन के निशाने पर नहीं होतीं हैं| उनके साथ बदसलूकी करना तो दूर, उन्हें छूना भी अपराध है| दूसरी और, कोई पुरुष अगर कुछ पैसों के बल पर कुछ घंटों के लिये किसी वैश्या की सेवा लेना चाहता है, तो पकड़े जाने पार उसके साथ पुलिस थानों में अपराधी की तरह सलूक किया जाता है| इससे वैश्यावृति पर निश्चित रूप से अंकुश लगेगा, क्योंकि वैश्याएँ या तो ग्राहक न मिलने के कारण इस पेशे को छोड़ देंगी या भूखी मर जायेंगी| ये ऐसे ही हुआ कि हम शराब बंदी के लिये दुकान तो बंद न करायें, लेकिन ग्राहकों को जेल में बंद करना शुरू करदें| ये शराबबंदी का कोई हल नहीं हुआ| जबकि शराब व्यक्ति के लगभग प्रत्येक अंग जैसे लीवर, किडनी, हृदय तथा मस्तिष्क पर प्रतिकूल असर डालती है| इसके विपरीत वैश्यावृति  से प्रेमिकाओं तथा पत्नियों से त्रस्त पुरुषों को थोड़ा धन खर्च करके यौन-सुख प्राप्त होता है, जिससे आत्महत्या, अवसाद तथा मनोरोगियों की संख्या में भारी गिरावट होती है| चिकित्सा विज्ञान की दृष्टि से यौन-सम्बन्ध बनाने से वेश्या तथा उसके ग्राहक दोनों का रक्त-प्रवाह बेहतर होता है तथा शरीर का प्रत्येक अंग जैसे लीवर, किडनी, हृदय तथा मस्तिष्क में रक्त-प्रवाह बढ़ने से सक्रियता में वृद्धि होती है| लेकिन समाज के द्वारा ये सुनिशित किया जाना चाहिए कि सेवा देने वाली स्त्री का ग्राहक उसकी सेवा का मूल्य न देकर, अथवा समाज उसको अपमानित करके शोषण न करे| पुनःसमाज के द्वारा ये भी सुनिशित किया जाना चाहिए कि यौन-सम्बन्ध बनाने से स्त्री अथवा पुरुष कॉन्डोम आदि का प्रयोग करें जिससे एड्स जैसे रोग का संक्रमण न हो| अतः हल यही है कि वैश्यावृति को कानूनी दर्जा दिया जाए| वैश्याओं की नियमित शारीरिक जाँच हो| इस पेशे से जुडी महिलाओं का पुलिस–प्रशासन से शोषण न हो| वैश्यावृति को कानूनी दर्जा  मिलने से समाज में बलात्कार, योनहिंसा में गिरावट आना भी निश्चित है| वैश्या भी किसी भी अन्य स्त्री की तरह यौन-हिंसा एवं बलात्कार की रिपोर्ट लिखा सकेगी| दूसरी और पुलिस –प्रशासन वेश्याओं तथा उनके ग्राहकों को पकड़ने के स्थान पर समाज के चोर डकैतों तथा भाइयों को पकड़ने का समय निकाल पायेगा| कुछ आकलन इस और इशारा भी करते हैं कि यदि मुबई पुलिस –प्रशासन वेश्याओं, बारडांसरों तथा उनके ग्राहकों को पकड़ने के स्थान पर दाऊद को पकड़ने में परिश्रम करती, तो दाऊद आज पुलिस की गिरफ्त में होता| लेकिन पुलिस –प्रशासन को भी पता है कि वेश्याओं, बारडांसरों तथा उनके ग्राहकों को पकड़ना चोर डकैतों तथा भाइयों को पकड़ने से अधिक आसान तथा सुरक्षित कार्य है|

Why is the exploitation of women in the name of prostitution?

                It is said that the position of women in the world and the country is getting stronger. They have achieved economic independence. Many women are at the top in their field of employment and business. The commercial success kisses her steps. In spite of all this, women are exploited in the name of prostitution, the oldest profession of the world related to them. Women, who justify the ban on prostitution sometimes in the name of empowerment of women or sometimes in the name of morality, are in fact, indirectly responsible for this exploitation. Cheap popularity can be easily earned by hypocritically pretending to oppose prostitution. But the need of the hour is to consider whether ban on prostitution will stop the exploitation of women or will further increase it. According to some figures, despite prostitution being almost banned in India, there are approximately fifteen million prostitutes in our country, which is more than the population of many countries of the world. Where from these prostitutes come? It is true, many times due to poverty some fathers sell their daughters, many times some lovers sell their girlfriends. Sometimes husband sends his wife to sell her body for money to meet out with the household expenses or of the expenses of his drinks. Some women willfully come into this profession to earn some money.  But the question arises whether a ban on prostitution will stop this exploitation of the woman by her father, husband or boyfriend. The answer is no, it will not stop.

                Prostitution is fulfillment of the sexual needs of a man by a woman and in return, he pays some amount for the physical service to that woman.  The responsibility of the society is to ensure that the reasonable price is paid to that woman for fulfilling the sexual requirement of the man. A ban on prostitution brings the poor girls wandering on the streets for earning some money to come up on the radar of the guardians of the law i.e. the police and the administration. These guardians of the law then took away a part of her hard earned money. Sometimes these guardians of the law or their top officials or the political leaders, who are political god fathers of these guardians, force the woman to fulfill their sexual lust also, and for free, which definitely, is exploitation. An example is of a profession different from prostitution, that is of bar dancers, which was banned by the then government of Maharashtra in 2005. This ban brought these bar dancers on road. It was a total catastrophe. Nearly 75,000 bar dancers had to do all kind of domestic work (and there is no evidence that in doing so, they were not exploited) or were exported to Arab and Southeast Asian countries or choose to be simply call girls to earn their livelihood. A ban on prostitution forces these women to live a degraded life in hiding, for no crime of them. Their crime is only that society does not like their profession. Their children are not given admission in schools and so are forced to re enter into the same “banned” profession. Prostitutes in ancient India were known as “Nagarvadhu” (bride of the city) and as this term itself explains that the life of these women was not so degraded and exploited as it is nowadays. This degradation started after the advent of Islam in India. The infidel women, after being won in war, were put in markets, in which they were bought and sold like animals, in a similar way as the Islamic State militants are doing with the Yajidis women. Some so called civilized countries like Sweden have taken a different approach to curb prostitution. There is no ban on prostitution but to buy body is illegal. So that the poor girls wandering on the streets, to earn some money, are not targeted by the police but the person who takes the services of the prostitute, is caught and treated like criminal in the police station. Prostitution will certainly be controlled as either the customers will leave approaching them or these woman will die of hunger. It is just as we do not go for closing wine-shops but customers being put to jail. This is also not a good solution for prohibition. The wine adversely affects almost every part of the body of its consumer like liver, kidneys, heart and brain.  On the other hand, prostitution provides sexual pleasure to a man tortured by his girlfriends and wife, by spending a little money. This causes a substantial drop in the number of suicides, depression and psychiatric cases. From the point of view of medical science, sexual process, for both the prostitute and her customer, causes an increase in the blood flow to almost every part of the body such as liver, kidneys, heart and the brain. This rejuvenates the body. But the society should ensure that the prostitute is not exploited by her customer by not paying for her service. The society should also ensure that the prostitute is not exploited by being insulted by the society itself for being into this profession. The society should also ensure that the sexual relations are made using condoms so that the diseases like AIDS are not transmitted. Therefore, the solution is that prostitution is legalized. There should be regular physical checkups of prostitutes. This will ensure that the women in this profession are not exploited by the police and the administration. This will reduce the cases of sexual abuse and rape in the society.  Prostitutes will also be able to lodge a complaint of rape or sexual abuse like any other woman. The police will then be free to catch the thieves, robbers or dons in the society rather than running after the prostitutes and their customers. Some estimates indicate that if Mumbai police would have worked so hardly to capture Dawood, as it is doing in running after the prostitutes and their clients, the don would have been behind the bars. But the police and the administration also know that it is much easier and safer job to catch the prostitutes and their clients, than to catch thieves, robbers and dons. …….
